CarDestiny LLC Vehicle Agent Service Agreement, 2025

Thank you for selecting CarDestiny LLC! We are excited to assist you in finding your next vehicle. This Service Agreement (“Agreement”) outlines the terms, roles, and responsibilities for our Vehicle Buying Service (“Service”). By enrolling in the Service and providing payment, you agree to be bound by this Agreement. Please review it carefully.

Overview This Agreement, effective immediately once payment is provided, is between you (“Client” or “you”) and CarDestiny LLC, a Virginia limited liability company located at 8401 Mayland Dr #8054, Henrico, VA 23294 (“CarDestiny”). Collectively, you and CarDestiny are the “Parties.”
Services In exchange for your payment, CarDestiny will provide agent services through one of three plans. Our goal is to advise and facilitate your car purchase saving you time, effort, frustration and to get you the best deal possible. In short we help you realize your car destiny. Services are delivered by a CarDestiny representative (“Agent”). The plans are:
- Auto Purchase Advisor ($299): Provides comprehensive guidance from start to finish on how to best buy your car on your own. It is conducted via phone call or video chat. The consultations consists of a maximum of 3- hours of 1 on 1 time with an Agent and with a maximum of 3 uninterrupted phone calls total.
- It includes consultation on:
  - Strategies to determine and locate your dream car based on wants, needs, buying power, and price range.
  - How to best set expectations and goals for your car-buying journey.
  - How to contact dealerships and schedule test drives while maintaining the frame of control.
  - Strategies to secure pricing and negotiation tactics to secure the best deal.
  - How to maximize trade-in value, if applicable.
  - How to take delivery and ownership, whether at the dealership, third-party long-distance shipping, or dealership-driven delivery.
  - How to navigate payment options (cash, financing or leasing), including interest rates, warranties, add-ons, and insurance.
  - How to understand contract terms and paperwork.
  - How to manage emotions, maintain poise, and stay tenacious with dealership staff.
  - How to minimize regrets and ensure satisfaction to manifest your car destiny.
  - Deep dives to answer any and all car-world related questions, propositions, and situations you can think of.
  - Note: With this package Agents do not interact with dealerships (e.g., no test drive scheduling, negotiating, transaction facilitation, or time-consuming research to match you with a vehicle. See Expert Deal Negotiation and/ or Complete Car Buying Service.)
- Expert Deal Negotiation ($499): Once you know precisely what you want, select our Expert Deal Negotiation. Agents save you the hassle by contacting dealership(s) on your behalf. We negotiate the best deal for you. This is the way car buying should be!
- Includes:
  - Throughout Communication about precisely what car you want.
  - Agent-conducts negotiations with dealerships to get you the best deal stress-free.
  - Agent facilitates vehicle purchase and helps set up test drives.
  - Agent helps stream line paperwork so you can spend as little time at the dealer as possible.
  - Agent facilitates taking ownership of the vehicle whether you drive it off the lot or ship it to your house.
  - Agent-conducts negotiations on sales contracts, extended warranties, or add-ons, if applicable.
  - Agent-conducts negotiations on trade-ins to get you as much money as possible, if applicable.
  - Note: (Customer will more than likely be responsible for any shipping costs if applicable).
  - Note: Does not include personalized vehicle research and matching (see Complete Car Buying Service).
- Complete Car Buying Service ($799): Includes all services from both Expert Car Buying Consultation and Expert Deal Negotiation,
- Additionally Includes:
  - Agent-facilitated personalized vehicle research and specialized matchmaking.
  - Agent facilitates purchase paperwork and dealership visit or shipping to take delivery of vehicle.
  - Researching vehicles matching your budget and preferences.
  - Arranging test drives or dealership visits.
  - Facilitating the transaction and coordinating delivery.
  - Comprehensive support to streamline the entire car-buying process.
Payment Terms
- “Auto Purchase Advisor”: $299 due upfront.
- “Expert Deal Negotiation”: $499 due upfront.
- “Complete Car Buying Service”: $799 due upfront.
- Payments accepted via credit/debit cards (Visa, Mastercard, AmEx, Discover) through a secure payment processor chosen by CarDestiny.
- All payments are non-refundable; see Section 6 for details.
Client Acknowledgments
- The Agent facilitates vehicle research and negotiations but does not:
  - Inspect, certify, or warrant vehicle condition, safety, or quality.
  - Accept vehicle deposits (paid directly to dealers).
  - Sign contracts on your behalf.
- The Agent is independent, receiving no commissions from dealers.
- CarDestiny may coordinate vehicle transport via third-party shippers but is not a shipper and is not liable for transport-related damages.
- CarDestiny provides advice, facilitates transactions, and coordinates vehicle purchases but does not guarantee savings or outcomes.
Client Responsibilities
- Provide accurate, complete information about vehicle preferences and budget.
- Respond promptly to Agent inquiries.
- Conduct due diligence on vehicle condition and contract terms.
- Ensure compliance with legal requirements (e.g., licensing, insurance).
- Pay any additional costs (e.g., shipping, travel) directly to third parties.
- For Complete Car Buying Service and Expert Deal Negotiation: Changing vehicle selection after agreement requires a $150 restart fee (not applicable if vehicle is sold to another buyer by prospective dealership).
Non-Refundable Policy: All payments are final. CarDestiny does not offer refunds, partial refunds, or guarantees of specific savings, as outcomes vary by client and vehicle.
Release of Liability: You release CarDestiny, its Agents, officers, employees, and affiliates from any claims, damages, or liabilities related to vehicle defects, condition, or performance, whether known or unknown, arising from your purchase.
Indemnification: You agree to indemnify and hold harmless CarDestiny and its representatives from claims, losses, or expenses (including attorney fees) arising from:
- Vehicle condition or performance.
- Disputes over taxes, DMV fees, or third-party services.
- Any agreements you sign with dealers or lenders.
Final Decision: You retain sole authority to accept or reject any deal negotiated by the Agent.
Dispute Resolution
- Governing Law: This Agreement is governed by Virginia law.
- Venue: Disputes shall be resolved exclusively in Virginia state courts.
- Process: Parties will attempt good-faith negotiation before legal action.
- Attorney Fees: The prevailing party in any legal action may recover reasonable attorney fees.
- Discretionary goodwill refunds are not admissions of liability.
Electronic Transactions: By providing payment, you consent to conduct business electronically under the Electronic Signatures in Global and National Commerce Act (ESIGN) of 2000.
Service Process:
- After payment, complete the online intake form provided by CarDestiny.
- An Agent will be assigned, contact you, and begin services based on your plan and intake responses.
- Services include vehicle searches, negotiation support, and delivery coordination.
- You are responsible for final agreements and payments to dealers.
Miscellaneous
- This Agreement constitutes the entire understanding between the Parties.
- CarDestiny may modify terms with written notice to you.
- Failure to enforce any provision does not waive it.

By enrolling in the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
